Fujisaki Melmaga Distribution Service Membership Agreement

Article 1 Definition

  1. "E-mail magazine Delivery Service User" (hereinafter "Service User") means a person who has agreed to the "E-mail magazine Distribution Service Terms of Service" (hereinafter "Terms of Use") on the registration screen on the Fujisaki official website and has approved it by Fujisaki Co., Ltd. (hereinafter "Company").
  2. "E-mail magazine distribution service" is an e-mail service in which Fujisaki provides various information to service users using the Internet.

Article 2 Scope of Terms

  1. These Terms and Conditions stipulate registration, subscription conditions, implementation rules, manners, etc. when the service user uses the e-mail magazine distribution service defined in Article 1.

Article 3 Changes to Terms

  1. The Company may add and modify new provisions to these Terms without the consent of the Service User by the method specified by the Company. Each time, the Company will notify the service users by posting the content on the Fujisaki official website, e-mail, or other appropriate methods.
  2. The Service User agrees to the addition and modification of the Operational Regulations or other provisions that are posted on the Fujisaki Official Site or otherwise presented, and it shall constitute a part of these Terms.
  3. Unless otherwise specified by the Company, the revised Terms of Use shall take effect from the time it is displayed on the official Fujisaki website.

Article 4 Registration of e-mail magazine delivery service

  1. If you wish to register for the e-mail magazine distribution service, you may only do so by the applicant for registration.
  2. The Service User agrees to the addition and modification of the Operational Regulations or other provisions that are posted on the Fujisaki Official Site or otherwise presented, and it shall constitute a part of these Terms.
  3. The registration of the e-mail magazine distribution service shall be completed at the time when the Company approves the application of the applicant for registration and informs the applicant of that effect.
  4. If some or all of the registered items provided at the time of application are false, misrepresented, or leaked, or if the applicant for registration has been revoked in the past, or if the Company determines that registration is not appropriate, the registration of the e-mail service shall be refused.
  5. Service users may cancel their registration at any time.

Article 5 Changes to Notification Items

  1. If there is a change in the e-mail address of the service user or other registered items, the service user shall promptly carry out the change procedure in accordance with the method prescribed by the Company.
  2. If there is a request from the Company to the Service User to add registration information, the Service User shall promptly carry out the registration procedure by the prescribed form or by e-mail, telephone, etc.

Article 6 Management and Use of Personal Information

  1. We will properly use and strictly manage personal information registered by service users in accordance with the privacy policy.
    In addition, we shall not modify or change the personal information of the service user without the consent of the service user.
  2. The Company will use the personal information submitted by the service user at the time of enrollment registration for the following purposes:
    1. Personal authentication
    2. Provision of email services
    3. Request for opinions, impressions, questionnaires, etc.
    4. Provision of benefits and after-sales services
  3. The Company shall not use the personal information registered by the Service User for any purpose other than the preceding paragraph. However, this does not apply to the following cases.
    1. With the prior consent of the service user
    2. When necessary to protect the vital interests of the service user, such as life, health, property, etc.
    3. When disclosure or provision is required by other laws and regulations

Article 7 Communication of e-mail

  1. When the service user and the Fujisaki official site administrator need to communicate by e-mail, the e-mail address registered by the service user shall be used.
  2. The Company shall not be liable for any disadvantages or damages arising to the service user in the communication of e-mail between the service user and the Company.

Article 8 Prohibition of Service Users

  1. The Company prohibits the use of information on stores, products, sales promotions, etc. provided on the Fujisaki official website for purposes other than private use by the service users. However, this does not apply to those that have been approved in advance by the Company.
  2. The Company prohibits the following actions when service users use the e-mail magazine distribution service.
    1. Acts contrary to public order and morals
    2. Acts that violate laws and regulations
    3. Acts linked to crime
    4. Election campaigns or similar acts and acts that violate the Public Office Election Law
    5. Acts that infringe the copyrights and other intellectual property rights of other service users and third parties
    6. Acts of slandering, slandering, or defaming other service users and third parties
    7. Acts that infringe on the property and privacy of other service users and third parties
    8. Acts that cause disadvantage to other service users and third parties
    9. Acts that hinder the use of services by other service users
    10. Acts that interfere with operation through e-mail magazine distribution services (such as falsification of information, input and transmission of viruses, etc.)
    11. Acts of tampering with available information regarding e-mail magazine distribution services
    12. For-profit activities not recognized by the Company
    13. Other acts deemed inappropriate by the Company

Article 9 Suspension or Suspension of the e-mail magazine distribution service and changes in content

  1. In the following cases, the Company may temporarily suspend or suspend some or all of the Fujisaki official website without prior notice or consent to the service user.   
    1. When urgent maintenance and inspection is required due to system trouble etc.
    2. When there is a problem with the first-class (telephone company, etc.) and the second-class telecommunications carrier (provider, etc.)
    3. When a fire or power outage occurs and services cannot be provided
    4. When services cannot be provided due to natural disasters (earthquakes, eruptions, floods, tsunamis, etc.)
    5. When services cannot be provided due to human-made disasters (war, riots, disturbances, labor disputes, etc.)
    6. In addition, when the Company deems it necessary
  2. In the event that a situation set forth in the preceding paragraph occurs and a disadvantage or damage to the service user, the Company shall not be liable to the service user.
  3. The Company shall be able to change, add or delete all or part of the contents of the service provided without the approval of the service user.

Article 10 Cancellation of Registration

  1. If the service user falls under any of the following items, the Company may temporarily suspend the use of the e-mail magazine distribution service by the service user or cancel the registration as a service user without prior notice or notice to the service user.
    1. When it is found that there is a false fact in the contents of the report or report to the Company
    2. Tampering or unauthorized use of the information of the e-mail magazine distribution service, and other obstructing the operation of the e-mail magazine distribution service
    3. If the e-mail address is not the address of the user of the service
    4. If you are unable to contact the service user by e-mail
    5. In violation of these Terms
    6. When it falls under or is related to antisocial forces
    7. In addition, when the Company determines that it is inappropriate as a service user
  2. The Company shall not be liable for any disadvantages or damages incurred by the Service User as a result of the Company's suspension of use or cancellation of registration based on Honjo.
       

Article 11 Attribution of Copyrights

  1. All copyrights, design rights, trademark rights, and other intellectual property rights relating to information and design, etc. posted on the e-mail magazine distribution service belong to Fujisaki or other legitimate right holders.
  2. All portraits of information, design, etc. posted on the e-mail magazine distribution service belong to the Company or other legitimate rights holders.
  3. There is no guarantee that the information, design, etc. provided on the e-mail magazine distribution service does not infringe on the copyrights, design rights, trademark rights or other intellectual property rights of third parties, and we shall not be liable for any disadvantages or damages arising from the use of these services.

Article 12 Disclaimer and Responsibility of Service Users

  1. The use of the e-mail magazine distribution service shall be at the responsibility of the service user himself / herself. The Company does not guarantee the service users that the usefulness and accuracy of the information and content provided by the e-mail magazine service or that the use of the e-mail magazine service satisfies or benefits the user's wishes.
  2. The Company shall not be liable for any damages incurred by the service user using the service provided by Fujisaki.
  3. If the service user causes damage to a third party by using the service provided by the Company, it shall be resolved at his own risk and expense, and shall not cause damage to Fujisaki.
  4. In the event that a service user causes damage to the Company by improper or improper means or method, the service user shall be liable for damages to the Company.

Article 13 Transfer of rights and obligations

  1. Service users may not transfer, transfer, or otherwise dispose of their status as service users or rights or obligations under these Terms to a third party without prior written consent of the Company.

Article 14 Governing Law

  1. The enactment, effect, performance and interpretation of these Terms shall be governed by the laws of Japan.

Article 15 The Court of Jurisdiction

  1. If a lawsuit is required between the Service User and the Company regarding these Terms of Use, the brief court that has jurisdiction over the location of the Company's head office will be the agreed jurisdiction court.

Supplementary Provisions

This Agreement will be implemented from May 2015.
